Terms of Service

1. Acceptance of Terms

By accessing or using the Cozy Sleep Systems website (cozysleepsystem.com), the Breathe by Cozy™ application, or any products and services offered by Cozy Sleep Systems Corp., a Delaware C Corporation ("Cozy," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to all terms, do not use our services.

2. Reservations and Future Purchases

2.1 Reservation Terms

Reservations for the Somnara Aura™ are available with a $25 fully refundable deposit. No full product purchase is currently offered. Target retail, subject to change: $699. Somnara Aura™ remains in engineering development. Product availability and timing will be updated as reliable information becomes available.

2.2 Refund Policy

• Deposit ($25): Fully refundable at any time before your unit ships. To request a refund, contact [email protected]. Approved refunds are processed within 5–10 business days of the cancellation request.
• After delivery: Purchases are subject to our 30-day return policy; the product must be returned in original condition with all included accessories.

2.3 Payment Processing

The $25 reservation deposit may be paid by card or an eligible wallet or payment method presented through Stripe, or through Cozy's embedded PayPal and Venmo checkout. Stripe reservations are recorded only after Stripe reports a successful $25 payment. PayPal and Venmo reservations are recorded as paid only after Cozy's server verifies a completed $25 USD capture from PayPal. Transactions made through Cozy's earlier hosted PayPal link require separate transaction-ID verification. Eligible Stripe Link customers may see Klarna among Link's funding options for the $25 reservation; availability, approval, plan terms, and any interest are determined by Stripe, Link, and Klarna. No full product purchase is offered. By placing a reservation, you represent that you are authorized to use the payment method provided. All prices are in U.S. dollars unless otherwise stated.

3. Subscriptions and Recurring Services

3.1 Clarity by Cozy™

The current planning target is six months of complimentary Clarity by Cozy™ access with an eligible Somnara Aura™ purchase, followed by $4.99 per month or $29.99 per year for Enhanced wellness insights and Enhanced Audio. Product and subscription prices shown are planning targets and may change before purchase availability. Final subscription terms will be published before billing becomes available.

3.2 Nocelle™ Scent Pods

The current Nocelle™ Scent Pod target retail price is $15.99. A discounted subscription is planned; pricing will be announced before enrollment opens. Nocelle™ Scent Pods are not currently available for purchase or subscription. Final pricing and subscription terms will be published when firm availability information is available.

3.3 Filter Replacement

$79. Replacement filters are not currently available for purchase or subscription. Final pricing, replacement guidance, and any subscription terms will be published when firm availability information is available.

4. Research Participation

4.1 Voluntary Participation

Participation in Clarity by Cozy™ research programs is entirely voluntary. Special offers on Clarity by Cozy™ may be available through the Somnus Institute™ for research study participants. Participation does not affect your access to standard device features.

4.2 Data Protections

All research data is de-identified using HIPAA Safe Harbor methodology before leaving our secure environment. Research partners receive only aggregated, anonymized datasets. Individual participants cannot be re-identified from research data. All studies require IRB approval before enrollment begins.

4.3 Right to Withdraw

You may withdraw from any research study at any time, for any reason, without penalty or loss of service access. Upon withdrawal, your contributed data will be removed from future analyses within 30 days. Data already incorporated into published, aggregated results cannot be individually extracted but will not be used in future analyses.

6. Product Disclaimers

The Somnara Aura™ is a consumer wellness device. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition. EchoLoom™ estimates and Clarity by Cozy™ wellness insights are informational only and should not be used as a substitute for professional medical advice.

If you have a sleep disorder or medical condition, consult a qualified healthcare provider. The Cozy EchoLoom™ Radar provides sleep stage estimates based on movement and respiration patterns; it is not equivalent to clinical polysomnography.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COZY SLEEP SYSTEMS CORP. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OUR PRODUCTS OR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

8. Indemnification

You agree to indemnify and hold harmless Cozy Sleep Systems Corp., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your violation of these Terms or your misuse of our products or services.

9. Dispute Resolution

These Terms are governed by the laws of the State of Delaware without regard to conflict of law principles. Any dispute arising from these Terms or your use of our services shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in the State of Delaware.

You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the modified Terms.
